By using blubirdiq.com (the "site") or sending us an enquiry through it, you agree to these terms. If you do not agree, do not use the site. The site is operated by BlubirdIQ LLC ("BlubirdIQ", "we").

What the site is

The site describes BlubirdIQ's lead delivery services for mortgage lenders and brokers. Sending the contact form is an enquiry, not an order, and creates no obligation on either side. The purchase of leads, including pricing, exclusivity, caps, delivery, returns and payment, is governed by a separate written agreement between BlubirdIQ and the buyer. If that agreement and these terms conflict, the agreement wins.

What we are and are not

BlubirdIQ is a marketing and lead generation company. We are not a lender, bank, mortgage broker or loan originator, and we do not make credit decisions, approve loans or set rates or terms. Nothing on the site is an offer of credit, financial advice or legal advice.

No guarantees

The site describes how the service is designed to work: filters, caps, delivery methods, verification, consent records and returns. Lead volume, available geographies and verticals, pricing, and the results you get from any lead are not guaranteed and depend on factors outside our control, including your licensing, your team and the borrower. Verticals marked “coming soon” may change or not launch.

Buyer responsibilities

If you buy leads from us you confirm that you hold the licences and registrations required to originate or broker loans in each state you receive leads for, that you contact consumers only as their recorded consent and the law allow (including the TCPA and state telemarketing rules), and that you handle their information in line with your own privacy notices and applicable law. The buyer agreement sets this out in full.

Acceptable use

Do not submit false information or information about another person without their authority, use automated tools to submit the form or scrape the site, probe or interfere with the site or the systems behind it, or use the site for anything unlawful.

Our content

The site, its text, design, code, the BlubirdIQ name, bird mark and logo belong to BlubirdIQ or its licensors. You may view and link to the site; you may not copy, reproduce or reuse its content or marks without our written permission.

Third parties

The site may link to or load resources from third parties (for example web fonts). We do not control those services and are not responsible for their content or practices.

Disclaimer and limitation of liability

The site is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, BlubirdIQ is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data, arising from your use of the site. Liability for the purchase of leads is set out in the buyer agreement.

Indemnity

You will defend and hold BlubirdIQ harmless from claims arising from your breach of these terms or your misuse of the site.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes about the site will be brought in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction. Disputes about a lead purchase follow the buyer agreement.

Changes and contact
